1. Acceptance of Terms

By creating an account, accessing, or using CramIt ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you must not use the Service.

2. Subscriptions and Payments

Billing: We offer paid subscription plans ("Sprint"). By subscribing, you authorize us to charge your selected payment method, processed securely via our third-party payment processor, Stripe.

Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle (monthly or yearly) unless you cancel it. You authorize us to charge your payment method for the renewal term.

Cancellation: You may cancel your subscription at any time through your profile settings. Your cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that date.

No Refunds: All payments are non-refundable. We do not provide refunds or credits for any partial subscription periods or unused services.

Price Changes: We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any price changes.

3. User Content and Intellectual Property

Ownership of Your Content: You retain all ownership rights to the text, files, and other materials you upload or input into the Service ("User Input").

Ownership of Generated Content: You own the quizzes, flowcharts, and other content generated by the Service from your User Input ("Generated Content"). You are solely responsible for this content and its compliance with applicable laws.

Our License to Your Content: To operate and provide the Service, you grant CramIt a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, display, and distribute your User Input and Generated Content. This license is limited to the purpose of providing, maintaining, and improving the Service, including sharing content at your request.

Our Intellectual Property: The Service itself, including all underlying software, code, branding, and design, is the exclusive property of CramIt and its licensors. You may not copy, modify, or reverse engineer any part of the Service.

4. Acceptable Use Policy

You agree not to use the Service to:

• Upload or generate any content that is illegal, harmful, infringing, or violates the rights of others.
• Attempt to reverse engineer, decompile, or discover the source code of the Service.
• Use any automated system to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce in the same period.
• Abuse the referral program or create accounts for fraudulent purposes.
• Interfere with or disrupt the integrity or performance of the Service.

5. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease, but any provisions of these Terms which by their nature should survive termination shall survive.

6. Disclaimers and Limitation of Liability

"AS IS" Service: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CRAMIT, ITS AFFILIATES, OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.

19. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any legal disputes arising from these terms or your use of CramIt shall be subject to the exclusive jurisdiction of the courts of the Philippines.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
